Tribunal upholds Wike’s re-election, dismisses PPP’s petition




THE Rivers State Governorship Election Tribunal has dismissed the petition filed by the governorship candidate of the Peoples Progressive Party, PPP, Mr. Clifford Edanuko against the re-election victory of Governor Nyesom Wike. 
It would be recalled that the Independent National Electoral Commission, INEC, had declared Governor Wike re-elected after he polled 886,264 votes to win the candidate of the African Alliance Congress, AAC, Biokpomabo Awara who pulled 173,859 votes. 
However, when the tribunal resumed, Tuesday (July 30, 2019), the Chairman of the Tribunal, Justice J.A. Orjiako, dismissed the petition, noting that Governor Wike was duly re-elected. 
Counsel for the petitioner, K. Otehi had based on the instruction of the petitioner moved a motion to withdraw the petition before the Tribunal. 
In an affidavit filed before the Tribunal, Otehi said that the petitioner sought to withdraw the petition so that governance would flow without any distraction in the state. 
He said: “We are all Rivers people.  The petitioner is a Rivers man. He has looked at it and said let’s give peace a chance.  The peace we are enjoying in Rivers State today is what everyone is happy about.  It will not serve the interest of the state to continue this legal tussle.”
The Counsel for Governor Wike, Chief Okey Wali (a Senior Advocate of Nigeria), said that it was gracious of the petitioner to withdraw the petition because his political party (PPP) is interested in the political stability of Rivers State. 
The Tribunal ruled that Petition Number  EPT/RS/GOV/O5/2015 stands dismissed, following  the motion on notice filed by the petitioner on 23rd July, 2019 for the discontinuation of the matter.  Ruling on the motion by Edanuko, Justice Orjiako corroborated the submissions of counsel for the INEC, Abdulhakeem Mustapha (SAN), counsel for Governor Wike, Chief Okey Wali (SAN) and Counsel for the People’s Democratic Party (PDP), Ken Njamanze (SAN) that there were no illegal terms of withdrawal.

The Supreme Court of Nigeria has sacked the governor-elect of Bayelsa State, David Lyon and his Deputy, Biobarakuma Degi-Eremieoyo. The court on Thursday in a unanimous decision by a five-man panel of Justices led by Justice Mary Odili, held that Degi-Eremieoyo submitted a forged certificate to the Independent National Electoral Commission, INEC.
